The Judicial Power is exercised by courts in the Republic of Belarus.

The judicial system in the Republic of Belarus is determined by the law. Regular and economic courts and other courts and judges exercise judicial power.

Regular courts of the Republic of Belarus include the Supreme Court of the Republic of Belarus, Regional, Minsk municipal, district (municipal) courts and also military court. Economic courts include the Supreme Economic Court of the Republic of Belarus, economic courts of Regions and equatable to them economic courts of towns and Districts.

The following specialized courts may be formed within the system of regular and economic courts: juvenile, domestic relations, administrative, land, tax and other courts. It is prohibited to form extraordinary courts.

The courts administer justice within the framework of the Constitution and other normative acts in the republic. The cases before the court are tried collegially, and in situations provided for by law — by judges individually.

The fundamental law provides for the right of the court to raise the issue regarding the recognition of the respective normative act to be unconstitutional, if in trying a specific case the court arrives at a conclusion that a normative act contradicts to the Constitution.

In administering justice, judges are independent and obey the law exclusively. Interference in activities of judges administering justice is impermissible and is punishable according to the law. Judges may not engage in business activities or perform any paid work, apart from teaching and research.

Supervision of constitutionality of normative acts is exercised by the Constitutional Court. The Constitutional Court makes a conclusion regarding constitutionality of the normative acts passed by all state bodies and non-governmental associations.
